Terms and Conditions1. Booking Conditions
• As ever, it is very important that you read and understand these terms and conditions as they form the basis of the agreement you are making with the owners of the rental properties (“the House Owners”) (through us). By entering into this agreement, you confirm that you have read, understood and accepted these conditions.
2. Definitions
• 'I', 'Us', ‘Our’ and 'We' means Tots to France whose registered office is at 56B Station Road, Nassington, Peterborough, Northants, PE8 6QB. • 'You' and 'your' means you (and, as appropriate any and all persons in your party), or visitors using this website (http://www.totstofrance.co.uk) (“the Website”)
3. Making a Booking
• All bookings will taken over the telephone, or via e-mail from the Website. If you contact us by e-mail then we will respond by e-mail also. If you prefer to be contacted by telephone, then please state this at the time of contact. • We will use reasonable endeavours to match your requirements with the properties available, and once we have reached verbal or written agreement on the property you wish to rent, we will send you confirmation by either post or e-mail. A deposit of 30% of the full rental amount due under the agreement (“the Rental”) is due on receipt of this confirmation. The full balance of the Rental payable becomes due 8 weeks before your departure date. Bookings taken within this 8 week period require full payment on receipt of confirmation from us. Payments made using debit or credit card via Paypal (or directly from your Paypal account) will be subject to a 2% fee. • If the deposit and subsequent balance are not received within 7 days of their respective due dates, the booking will be deemed to have been cancelled. Any deposit which has already been paid will not be refundable. • In addition to the Rental, a refundable security deposit will be levied and is payable at the time that the main balance of the Rental is due. This will be returned as soon as possible on your return. It may be used to compensate owners for breakages or non-payment for services payable locally. If possible, we will take this amount as an 'authorisation' on your credit card which means the amount will not leave your account. We will only ever withhold re-payment (or take payment from your pre-authorised card) in consultation with you and the House Owner. 4. Cancellation and Changes to Bookings
• If you wish to change your booking, then please contact us at the earliest opportunity. Whilst we will use our reasonable endeavours to help you change your booking, we cannot guarantee that all or any of your requests can or will be accommodated. If your change incurs extra costs, these will be added to the total Rental due at 8 weeks prior to travel. If changes are made within this period, then payment will be due immediately, and confirmation of such changes will not be made until payment is received. We reserve the right to charge a small fee if required to cover administration costs associated with such changes.
Refund Policy
• If you wish to cancel your holiday, then you should contact us at the earliest opportunity. As we pass on your deposit to the House Owners, your payment is non-refundable. Once full payment has been made, then your payment will also be non-refundable. We will make every effort to re-let the week that you have cancelled. If we successfully re-let the cancelled period, you will receive the Rental minus your deposit and an administration fee of 10% for the extra work involved. Your deposit will not be refunded. • We understand that with young children, unforeseeable events may preclude you being able to travel at the last minute. For this reason, we urge you to take out adequate travel insurance as soon as you make the booking; alternatively, annual insurance policies are often good value. We can advise you on insurance if you wish. Taxe de Sejour • Please note that French law dictates that a small tourist tax known as 'Taxe de Sejour' is charged locally. The collection of this tax is at the discretion of the local commune; you may therefore be asked to pay half a Euro per person (aged 13 and over) per night whilst you are at your accommodation to cover this compulsory tax.
5. The Role of Tots to France
• Tots to France is an agent acting on behalf of the House Owners in France. It is important to understand that by asking us to undertake a booking on your behalf, you are entering into an agreement with the House Owner and that you are liable to the House Owner and the House Owner to you. • This arrangement has implications that you should be aware of. The extent of our liability to you is as set out in clause 6 below.
6. Liability of Tots to France
• As agents, we will always endeavour to ensure that your holiday arrangements run smoothly, but we are not liable for the actions of the House Owners, their representatives or any person not employed by us. • We have visited all the properties advertised on our Website, and whilst we use all reasonable endeavours to ensure that all descriptions of the properties are made in good faith and are accurate, we exclude liability for any inaccuracies, omissions or mis-descriptions of the properties or for your subjective interpretation of any such descriptions. • You will of course be informed of any last minute changes to items available, but we do not guarantee the accuracy of any of the items listed. • If any problems occur on your holiday, you may contact Tots to France for assistance should the need arise, but we do not guarantee to be able to rectify any local problems either where this is the responsibility of the House Owner or where you fail to follow the complaints’ procedure outlined in clause 7 below. • Save as expressly set out above, all warranties, terms and conditions implied by law or otherwise are excluded to the fullest extent permitted by law. • Tots to France excludes all liability for any and all special, indirect or consequential losses, damages, costs or expenses suffered or incurred by you as a result of your booking, your stay at the property, or otherwise in connection with your agreement with the House Owner. • Out total liability to you in contract, tort and statutory law shall not exceed the Rental payable by you under the agreement. • Nothing in this clause 6 shall be deemed to exclude our liability for death or personal injury caused by our negligence or for fraudulent misrepresentation.
7. Complaints
• It is very important to us and the House Owners that you enjoy your holiday. If there is anything that gives rise to a complaint, then you must inform the House Owner or nominated representative as soon as possible. We do not accept any liability on behalf of the House Owner for problems arising with the properties. • We will however attempt to address any complaint you cannot immediately rectify locally as long as you contact us as soon as possible and supply written confirmation of your complaint to us within a week of your return. We offer this service to ensure a positive outcome to any problems that may occasionally arise and will use all reasonable endeavours to rectify a problem within 48 hours of being notified of the problem. If we are unable to rectify or procure that the House Owners/nominated representatives rectify a problem within the initial 48 hour period, Tots to France will then be responsible for any and all losses suffered by you as a direct consequence of the problem in question. • If a problem arises that cannot be rectified, Tots to France, at its own discretion, may offer to re-accommodate you in another property. If such an offer is made but not taken up by You, Tots to France will not subsequently be liable for any compensation payments to You. • For the avoidance of doubt, Tots to France shall not be liable to You for any and all special, indirect or consequential losses, damages, costs or expenses suffered or incurred by You as a result of any problems with the properties.
8. Force Majeure
• There are certain things that we cannot reasonably foresee and avoid. In these instances we do not accept liability for any loss, damage or inconvenience resulting to you, and will not be obliged to compensate you. Examples of such events include the breakdown of local services, plumbing, electrics, or problems with swimming pools, war or threat of war, civil strife or riot, terrorist activity or the threat thereof, natural disaster, weather, fire, industrial dispute and all other events which are out of our control. We cannot accept any responsibility for the closure or congestion of roads, ports or airports.
9. Your Responsibilities
• You undertake to behave in a proper manner; to avoid causing nuisance or annoyance to the owner, neighbours or other holiday makers. • You are responsible for the actions and behaviour of the other members of your party who are staying at or visiting the property during the rental period. • Details of any pets must be given at the time of booking. • You undertake to take good care of the property and its fittings and furnishings. Please treat the properties like they were your own. You should leave all furniture, fittings and fixtures in the same position and condition as you found them on your arrival. You are to leave the property in a very clean and tidy condition having reported any breakages or other problems to the nominated representative at the earliest opportunity. • We understand that breakages do happen! Please do not replace broken items unless asked to locally. Breakages will be treated on a case by case basis and costs, repair or replacement may be taken from the security deposit. If the cost of repair or replacement exceeds the amount of the security deposit, then you will be liable for the difference. Once again, you are strongly advised to seek adequate insurance to cater for such a situation. Please inform the local contact of any breakages as they happen. • You will understand that the use of facilities such as swimming pools entails a certain risk. The use of such amenities (including any sports and recreational equipment) is entirely at your own risk, and due care and attention should be paid at all times. • All swimming pools provided at our properties comply with the latest French laws, but this does not guarantee complete safety for very young children. Please supervise closely all activities in the vicinity of the pool. • If baby-sitting is offered, it is payable locally in Euros. The employment of baby-sitters is entirely at your own risk and you should understand that we have not undertaken any vetting process nor do we specifically recommend any one individual. The availability of this service cannot be guaranteed and you should satisfy yourself that you are happy to leave your children in the care of another person. • You undertake to ensure that no more than the maximum number of people listed on the particulars stay in the property. Exceeding the maximum limit may invalidate local insurance and the owner reserves the right to refuse admittance to any additional persons found using the accommodation or amenities therein. You may also be liable to eviction with no right to compensation. • You should not arrive before the specified time on your day of arrival and you should ensure that you vacate the property before 10am on your day of departure. Please ensure that the property is in a clean and tidy condition otherwise an extra cleaning charge may be levied or taken from your security deposit. • You should not use towels or linen supplied in the property outside. Please supply your own towels for outdoor use. • You should pay the Taxe de Sejour if requested by the local representative.
10. Use of the Website
• Nothing on this Website constitutes an offer on our part. All arrangements referred to are subject to confirmation. • Travel times shown are approximate and are based purely on mileage; please ask for advice on travel to your chosen property. • No part of this Website may be reproduced or used for any commercial use. • The Website may contain inaccuracies; it may at times be out of date. We retain the right to change any details shown with no notice. You must ensure that all details of your chosen holiday arrangements are correct at the time of booking.
11. Governing Law and Jurisdiction
• These terms and conditions and your agreement with the House Owners shall be governed by and construed in accordance with English Law. • The English courts shall have exclusive jurisdiction over any disputes arising as a result of the agreement between you and the House Owners; and in respect of any matter in these terms.
